Can anyone help me out with the case law which states that as long as officers are acting in good faith and know they are acting under a power they do not need to know the exact act or section... or something like that? Cheers MN

Hi, My ex boyfriend and I had an argument. He grabbed me from behind and pulled my hair. The police were called and he was arrested. He was charged and his solicitor said he could get up to 6 months imprisonment. He has now gone back home to Newquay, which is over 300 miles from were we were living. I want to drop the charges and want to know how can I do this and what will happen to my ex. I rang the station and they said it was up to the police officer in charge if he wanted to drop the charges. I dont want my ex to go to prison can any one help me please? Situation is a woman is insured on a car with a surname of Middleton for example, she then gets married and changes her surname and she doesn't tell the insurance company about the change of surname, because she doesn't want to pay the admin fee. According to the policy the only person shown as driving the car is Kate Middleton, however she is now Kate Windsor, so she would not be shown on the policy. Would this situation be classed as having no insurance or not? Apologies for the choice of names!

hi im just after a bit of advice,my 16 year old son was assaulted by a group of 12 men,it looks like 4 will be charged but as of yet we dont know what with.The officer in charge says a possible section 18 because they used baseball bats ,housebricks and actually chased him before they caught up with him,but ive been told it might be a section 20,my question is how can there not be intent if weapons have been used any advice would be appreciated

I would like to know if im allowed to push my OFFROAD DIRTBIKE about 500 yards up the street to the garage to wash my bike at the Jetwash? I only ever ride on Legal practice tracks (Sedgefields etc..) and sometimes on the way home we havnt got time to stop the van and wash 4 - 5 bikes on the sunday tea time, everyones thinking of there Dinner lol. Ive got a clean driving licence (8 years) and wouldnt want to risk getting any points, as i drive for work aswell. I was told if you take the chain off then its classed as unrideable, any help would be appriciated thanks

I work in a busy bar and we were under staffed so there was a lot of frustration with some of the staff, I had a confrontation with a colleague, we've had verbal fights before but this night he decided to go one step further by shoving me with both hands and then head butting me clean on the forehead, I haven't checked the CCTV footage yet but I think this incident happened in a blind spot (typical) but one of the other barstaff said he saw what happened. I didn't lay a finger on him but did give him a few words of warning if he tried it again, I have a few questions regarding this issue: 1) Is it worth going to my local police station and have him charged with assult? …

I was subject to an assault by my ex partner where photos of my injuries were taken for evidence. Does anyone know if I'm able to have copies of these along with a copy of my statement? Thanks in advance for help

So as I enter my tedious final half hour at work I starting perusing through different legislation etc and was re reading S17 PACE as you do.. Subsection 5 caught my eye as one that I had not properly seen before, it states... Subject to subsection 6 below, all the rules of common law under which a constable has power to enter premises without a warrant are hereby abolished. Does anyone know what these common law powers of entry were or know of a site which might help? I have hashed it out on Google and most of the results relate to this gateway act that they are pushing through... As always any help will be greatly appreciated.

Until recently I thought this would be s. 5/4 POA offence. However Threats to kill, contrary to section 16 Offences against the Person Act 1861 Threats can be calculated and premeditated, or said in the heat of the moment. The defendant does not have to have the intention to kill but there has to be an intent that the person to whom the threat has been issued would fear it would be carried out. This can be a difficult offence to prove, and it should be reserved for the more serious cases.
