Hi all Sorry, another question - blame the rain for keeping me in ! Has anyone ever seen sec 44 of the magistrates court act used ? (relates to aid, abet, council or procure the commission of a summary offence etc ) as it relates to what might be looked on as a low level of 'crime' (summary only) im wondering if it has any real 'value' being something that no-one is going to use or prosecute for. I was bullied and racially abused in my work. When under my manager pressure I was withdraw my complain again my work collegue. After two weeks my work collegue make the false accusation that I was assault the child in my care. I was suspended from my work and I have informed that I am going to call by police . After the few days I was called to the police station and I was interview under caution. The police told what I been accused for . My collegues said to the police that i was sitting on the child and hold him on the bed. The police said the didn't find any proof and the any bruises on the child. I always thought it was section 267 police reform act 2002, but im not sure, I was in a pub with a friend and a gent was trying to get free drinks by saying he was a police officer, when he left to sit down i asked the bar made to check to see if he had a warrent card to make sure he was a police officer, and to ask not to use his warrent to get free drinks, later that night i went back to buy another drink an she said no, he didn't even no what a warrent card was, i didnt get involved but i was just wondering what the law was on this? I know that for a contemp note interview you remind them they are not under arrest, legal advice, the purpose of the interview then the when caution. After you have completed the questions (and no further neeeded) do you ; - Report for the offence, now caution - TFBR, now caution I am slightly confused Thanks if you can help

My ex partner wants to move to France with her new husband and our 2 children, but there is a prohibitive steps order in her way. She's known since January that she wanted to move in June, I made my reasons for opposing the move very clear, but said if she wanted to alay my fears over lack of contact etc then if she complied with 3 conditions I would discuss the matter further. What law do the police use to close off certain areas to the public during special events like the Jubilee and torch relay. I know there is a RTA which covers roads but how about pavements?

Hi… I'm a very old member of this forum, returning to ask a question. Forgive me (and feel free to move it) if this is posted in the wrong board. Back in May I was a naughty boy and got snapped by a speed camera (36 in a 30). I got an NIP through the post and returned it in a few weeks. That was well over a month ago now and I've heard nothing back. Any suggestions as to what that might mean? Lost in the post? Matter dropped? Huge backlog? Any thoughts welcome. Thanks :new_hmmm:

How do graduated tickets work? I understand that they are for drivers who are of NFA or foreign nationals & cannot be reported using a normal (E)FPN, and the fine must be paid on the spot. But my questions are: Who can issue them? (I've never come across one in my nick) When is it appropriate to use them? When were they introduced?

I was with a regular officer this week who said instead of using a 136 you could use the mental capacity act but carnt find any information on sections of detention or anything to do with the police Can anybody help? Jonathan

Can anyone help me please? I'm not in the police force (and not a criminal either), but am completely out of my depth! My 25yr old son has been issued with an Osman Warning, which I understand means that the local police force believe that there is an immediate and real risk to his life. Hi there. Just a quick question really. Are the police allowed to ignore traffic laws in non emergency situations (ie with lights and sirens off)? I ask this because in the past year or so I have noticed the local police briefly turning on their lights in order to ignore stop signs, traffic lights etc, only to then switch them off and return to normal speed. Demonstrably not responding to an emergency. Are they allowed to do this? If so, fair enough I'll shut up and just put up with it. I just want to know for sure.

I have a question for the serving officers. I am out and about every day, weather permitting, shooting various species in different parts of the country. I have three knives that are used for different purposes. one is a six inch fixed blade with a serrated edge on the reverse, when dressing deer the serrated edge is used for cutting around the joints to remove the legs this keeps the main edge sharp for the gralloch. The second is a five inch fixed blade with a bright yellow handle, this is for gutting rabbits and is handy because it is difficult to misplace when being used in the middle of the night. I'm been encountering a lot of individuals going "lamping" recently. For those who don't know, "lamping" is the use of a high powered lamp to shine into a rabbits eyes to cause it to freeze, so that a dog can be set upon it. Strangely, I work in a inner city. I've never caught anyone at it, just found people late at night, carrying high powered lamps, and walking lurcher type dogs, sometimes wearing camouflage clothing. Often, when asked they simply admit that's what they intend to do. So, here's the question : Any offences ? I've read the Night Poaching Acts, which don't appear to apply to these circumstances. Anyone have any insight ?
