I had an incident at the weekend at a building containing a few thousand people who had all consumed some amount of alcohol. The fire alarms went off so we had to evacuate. There was already a large number of people outside the door smoking and more people on their way in. As we tried to get people out, other people were going in and we couldn't get people to move away from the door to make room for those coming out. I've come across various examples of reasonable force being justified when dealing with someone committing a crime. But where do we stand when they are just hampering an evacuation (bearing in mind I'm a door supervisor and so don't count as emergency servic…

What can be done about the continuous barking of a neighbours dog. Happens early in the morning, throughout the day and at night. Its so annoying, yet we are good friends with these neighbours and not wanting to stir up trouble or make things uneasy. Is there any law or official police warnings for this matter? Thanks

I am a bit confused with this topic.. What I understand is that you cannot attempt to commit a summary offence. If this is so you cannot attempt to steal a conveyance. (TWOC) To combat this we have sec 9 Criminal Attempts Act 1981. (Interfering with motor vehicles). As a pedal cycle is not a TWOC offence sec 9 cannot be used. How do you charge someone for attempting to steal a pedal cycle???????

Here's a situation that tricked me the other day. I arrested two lads for theft of a motor vehicle. It was a theft as opposed to a twoc because they burnt the vehicle out. During interview, one lad said that he had been forced to steal the car by the other lad because the other lad didn't know how to hotwire the vehicle. He told me that if he hadn't had helped to hotwire the car, the lad had threatened to break his legs. Following CPS advice, both will be getting charged for theft. It did make me wonder though, would this not technically amount to a robbery?? ie. the threat of force was used on a person at the time of committing the act of theft.

Hello all, Not sure if this is in the right section but mods can move it if not. I'm wondering what to do if you get harassed by your local police? I live in the Scottish Borders and my situation is the traffic police will not leave me alone. I'm a new student and I've taken a look at the section in my notes on the Theft Act 1968. I've seen the definition of theft to be section 1. Then my notes say section 2 is the definition of what dishonestly is NOT. Cool. I got this too. Reading further I see it describes all the bits of section 1. Then I read the notes for Theft act 1978 and saw that making off without payment is section 3. So now I'm confused. Wasn't section 3 of the Theft act a description of appropriation? Or is this a completely new act that just happens to share the same name? I always thought that acts in subsequent years sharing the same name as previous ones are amendments. A pal of mine is a re-enacter, she asked me recently about the validity of carrying a (fairly large) knife when in full Elizabethan dress as a prop and an eating utensil. She also mentioned that a lot of people wear proper swords, real but always sheathed. When they go to the pub they leave them outside. One of my friends thinks its all ok as they're "props" what's the view in the eyes of the law?
