I haven't started my training yet, but have recently been trying to understand when to use the different cautions. As I understand it, as soon as you suspect an offence, the 'when' question should be used, but the person should be told that they are 'not under arrest and are free to leave at any time'. The thing is, surely if the person has been told this by you, and they have committed the offence, they'll snap up the opportunity and leave, stopping you from questioning them and finding out more. If somone stands outside a bar - not doing anything or holding any banners etc, can you arrest them for under S5 Public Order Act? Would your answer be different if the people inside the bar stated that they felt alarmed and distressed at the person standing outside? How would the ECHR interplay with this?

The other night duty me and my colleague stopped and detained two males for the purposes of a s.1 search. One of the males was compliment whilst the other male started to hurl verbal abuse and then tried to run off. Me and my colleague chased after this male who refused to be searched and we ended up taking him to the floor. During the struggle my collague received cuts to his arm. The male once on the floor still refused to be searched and was arrested for obstructing police and assaulting police. Back at the station the custody sergeant refused to authorise detention because he stated that obstructing police can only be an offence where you obstruct anothers search not…

As we all know some offences are prosecuted and enforced by the local authority....does that completely negate our power to intervene/arrest/report for such offences if we were to come across them? Would our standard s.24 powers of arrest come into play if we, say, saw someone's dog fouling, someone smoking indoors etc etc and the person was not forthcoming with a name and address etc?

sorry if this is in the wrong section as im sorta new here, but anyhow, i wanted to ask what type of laser pen is illegal on the street or public place? i have a 1mw laser, is that street legal and can easily reach 5miles+? i dont intend on doing anything illegal with it ( pointing at people or planes )

Saw this on the news: http://www.bbc.co.uk/news/uk-england-london-11650729 I have had a look at the Town and Country Planning Act 1990 http://www.legislation.gov.uk/ukpga/1990/8/part/VIII/chapter/III and guess that it must come under an "Advertisment"??? I'm not interested in impersonating police officers / pulling people over or acting like an idiot. I was the first to come across a car overturned and on fire on a slip road off the M27 a while back. Cars were bombing down, despite best efforts of 3 or 4 people. If one were to come across an accident and there was a significant risk to road users, could a blue light be used to warn road users of a serious hazard on the road? I appreciate Reg 16, Road Vehicles Lighting Regulations 1989 (although I have no idea what the penalties are of breaching any of the rules), but wonder if common sense would prevail and accept that road users are more likely to pay notice to a bl…

My car tax is due to expire on 31/10/10, my new tax disc arrived from the DVLA today (I did it online), am I OK to put it in my vehicle now (it expires 31/10/11), or is there a start date that I have to wait for (eg 1st November). I don't want to fall foul of any law, ie the failure to display, but it would just be easier to pop it in the tax disc holder now and have done. Thanks in advance Mossycat

After a lenghty argument with my ex-girlfriend resulted in her shouting in my face, and me spitting at her. later that evening she slapped me and i have pinned her down to protect myself from getting hit futher without going into too many specifics these are the two incidents i am getting charged for. I have previous as a minor, and a caution as an adult. all convictions but the caution are spent i wonder, if i may ask what are the likely outcomes to this case, which is in court tomorrow. i will keep you updated. thank you.
