You are on duty as a police officer, at this particular moment you have entered a supermarket to buy a drink. As you are waiting in line to be served you hear some loud noises coming from the entrance and decide to investigate. You approach the entrance, there are staff members who are holding this lady and her child. There is a large amount of shopping inside a trolley, one of the staff approach you and say that this person has not paid for the shopping and has exited the store. They have seen it and also have it on the CCTV. At this point what are the steps that you carry out in order? For example. Do you arrest on the spot after asking exactly what has happened, do y…

Guys and girls, I have a scenario for you all and wondered what you would do in the situation. Its a Sunday afternoon, You are out on response and you get a call to assist a pcso on the hurry up, there is a male who has approached him and threatened to headbutt him if he is not arrested. Upon arrival the pcso explains that the male approached him and got close to him and stated if he wasn't arrested he would headbutt him before putting his arms behind his back then walking off. However the pcso has stopped him again. The male is a little drunk but is still at the level of which you could issue a ticket or report him if you chose to do so. What action would you take …

Ive been diverted of another thread( or two) for going of topic and been invited to start my own, so ive made the title as broad a possible so its hard to go off topic my knowledge of PACE( such as it is) come from a Continued professional development course i attended a few years ago. Aimed really at when you or your company comes under scrutiny for criminal offences. be that the Police ,HSE or environmental health et all The course was 10 days long and run by an Ex DCI who it seems was something of an expert as he was doing a PHD on this. and as above was from the perspective of making it as hard as possible for the law enforcement agency to get a conviction whilst s…

I apologise If the question come across a bit basic and silly. Whilst I believe I have a reasonable understanding of the most common search powers : s1 & s23 I was wondering.. For example: You are on foot patrol. Person A sees you and decides to run away in the opposite direction. You've made eye contact, something is definitely not right. Nothing has come on the radio. You're pretty sure he was running away after seeing you, a police officer. You catch up with him but you're unable to detain or search him under s1 one right? As you must be looking for something specific? Assuming no smell of cannabis, pupils were fine etc and s23 was not an option in this scenari…

Adam sits down in a restaurant and orders lobster and an expensive bottle of champagne. He fully intends to pay for his meal. The waiter opens the champagne and brings the lobster to the table. Just before beginning his meal, Adam calls the waiter over and says something to him. The waiter is very angry and calls in a police officer who is walking past the restaurant, complaining that Adam has just racially abused him. The officer decides that Adam's arrest is necessary and removes him from the restaurant. As the police are leaving leave with Adam, the manager comes over and asks that Adam is first allowed to pay the £250 bill for the meal he has ordered. "Fat cha…

Ive been fascinated by the recent cases of police officers suing property owners for breaching their duty of care whilst they were engaged in police activities and wondered how it worked the otherway For this scenario. a frail 83 year old wopman lives with her son a registered carer, in a large Victorian terrace, whilst the son is ouit at the shops, the police carry out a warenteed raid on next door were as they smash the door down with one of them ram things When the son returns he find the old lady in a state of shock, she reports hearing bang she has not heared the like of since the blitz, numerous pictures and momentoes have fallen of the wall. cabinets , she then s…

I observed this on the way to a job: You are in an area where the local residents have complained about urinating on the streets as their top "hate." It is 11pm at night and observe an elderly gentleman emptying his urine bag onto the street in a doorway What would you do??

I have got some questions arising out of the unregistered car post in the law section and rather than hijacks that thread, I though a scenario might be in order You as a policeman pull over a trail bike with no VRM fitted, on investigation it turns out, that the bike is unregistered with the DVLA, having been a comp bike. He has just bought it and is taking it home, he is insured by virtue of a traders policy and has a full bike licience. . it has road legal tyres, mudguards and exhaust, but no lights, horn, passenger pegs and as above no plates,.It obviously has not VEL or MOT despite it being 6 years from date of manufacture What offences is the rider committing b…

If the defintion of a POLAC is something along the lines of "a police vehicle being within visible sight of a RTC at the point the RTC begins" then which of the following are treated as a POLAC. 1) Police vehicle is parked across entrance of side turning blue lights flashing. MOPs vehicle on main road is following too close behind a HGV and intends to turn left into road which is now closed. MOP starts to turn, sees police vehicle brakes hard and collides with lamppost. 2) Same as 1 but instead of police vehicle there is just a Police ROAD CLOSED sign. 3) Standing by the Road Closed sign is a constable in full hi-viz. 4) Unattended police vehicle parked in layby. Cycl…

Criminal damage A person breaks off the wing mirror of car whilst in a strop. The cost of the damage caused is £50. He runs home. The police follow. The officer knocks on the door and mother answers. The villain of the piece is in the hallway. Looks surprised and runs up the stairs saying "Eeeek!! Tis the fuzz" Mother says, " go away police persons" . Do the police have power of entry to push mother out of the way, run into the house and arrest the naughty boy? Oh and and I have the answer base on reality and barristers and solicitors discussing this one! It is an interesting point of law too....

Consider this, G has been using the quiz machine in his local (one of these) He inserted £2 and answered all questions correctly - his credit now reads £22. A male in the pub (T) dislikes Gs winning streak and begins to irately hit the buttons on the machine in anger. His outburst causes no damage however it does cause G to loose all of his money. If intent could be proven what offences are we looking at? (if any!) Some kind of fraud? computer misuse? gambling offences? or some kind of a civil matter? Thoughts/ideas welcome!

Hi there, I know that this forum isn't intended as a legal advice drop-in centre or anything like that, I was just curious what the consequences would be and so on. I weren't personally involved in this situation but I was made aware of it happening to a friend a few days later. Anyway the scenario is, two people are at a pub, one of them is intoxicated and the other isn't. The person intoxicated is the driver, and the other person is only a provisional licence holder of which has had lessons and so forth, I know that's irrelevant as it's still illegal - well what I'm about to explain is. So, they want to get home but the intoxicated person wants to drive home, and…
