I'm sure this question has been asked before, but couldn't find the thread! Just want to know the reason why, (in relation to burglary( "damage property" exists in 9 (1)a but not 9 (1)b? Thanks in advance

With regards to persons in custody - where does our power come from to cut trouser cords etc? Are we obliged to compensate persons for damaged clothing?

My first topic in this area, so will try my best to make it clear what I am asking! Here's the scenario... A man is drinking in a pub that he very regularly frequents (multiple times a week) and the staff know him very well. He sits in the pub all afternoon consuming numerous pints, gradually getting drunker but never getting rowdy etc. Clearly drunk, he gets up and leaves, gets in his car and drives home. None of the bar staff have any real ideal how much he has had to drink because the drinks have been bought in rounds and individually and served by a number of different staff. Due to the remote location of the pub and the fact that he has driven there means that bar…

Hello, I would like to ask a question regarding what forms of action are reasonable in the following circumstance. When my wife becomes angry, which happens quite regularly, she will often demand that I keep talking to her until she has finished, no matter for how long a conversation/argument has already been, nor how late and/or tired I might be. This is happening an a daily basis at the moment. Say we have been talking or arguing for a couple of hours and he time reached 11am, I will often politely and calmly ask that we stop, and continue at a future time. She refuses, and continues, often with an increase in insults and anger. I ask again, it gets worse and I be…

Apologies if I've chosen the wrong place to post this. I've been having a discussion, for months now, with a few American friends who have been comparing rates of violent crime between the US and England and Wales. I've explained that definitions of violent crime, and methodology of recording crime, are so different as to make direct comparison virtually impossible. For definitions I've managed to (roughly) compare three of the four offences that constitute, "violent crime" according to the FBI (murder and non-negligent manslaughter, forcible rape & robbery). Looking at the numbers from the FBI & Home Office, the main 'definition' sticking point is, "Aggra…

Ok so outside by building at work the council are issuing fines under environmental law to poeple who drop cigerette butts. I heard via the grape vine that a member of staff refused to give details and walked back into the building. This got me thinking what powers, in these circumstances, if any would the PSCO have to follow them into the property to get details? The follow on to this is does the council warden have powers to enter?

Why do we have an offence of Causing Death by Dangerous Driving rather than just charging people with Manslaughter. It seems that plenty of people take the attitude that the consequences of bad driving are "just an accident" and the driver is not really to blame. I feel that if we were to charge people who kill as a result of dangerous driving with manslaughter it would send a clear message that drivers are responsible for the results or speeding, dangerous overtaking etc.

Hi all, Have just been reading through the updated PACE Code G document and I notice section 3.2 has been removed. Does this mean that the caution + 2 is no longer required when questioning someone about an offence who is not under arrest? ie so now you only have to tell them the caution and not the fact they're not under arrest and that they're free to leave. Or, is this covered somewhere else now? In the 2006 version of code G, 3.2 read as, "3.2 Whenever a person not under arrest is initially cautioned, or reminded they are under caution, that person must at the same time be told they are not under arrest and are free to leave if they want to." Cheer…

Hello, I was just reading my long notes, which recently replaced the infamous white notes. I had a questions in regard to section 5, public order. My notes state Mental element A person is guilty of an offence under section 5 only if they intend his words or behaviour, or the writing, sign or other visible representation, to be threatening, abusive or insulting, or is aware that it may be threatening, abusive or insulting or (as the case may be) they intend their behaviour to be or is aware that it may be disorderly. This element will be shown by asking questions such as Why did you do it? and What did you want to achieve? The offence can be committed in a public o…

Clearly there's some overlap with the offences of possessing an offensive weapon in a public place and possessing a bladed or sharply pointed article in a public place. However, say you stop search someone and find a large kitchen knife in their possession. Would you arrest for S1 Prevention Of Crime Act 1953 or S139 Criminal Justice Act 1988, and why? From what I can tell, a bladed or sharply pointed article is an offensive weapon (either made or adapted) and so I don't understand the need for S139. Hope that makes sense!

My son is 18 and holds a UK provisional licence and a current CBT certificate, I have a full 'old school' category A licence. We have a family 'ped and I am considering buying a motorbike which I am happy to share with him but I am confused by the new licencing structure. What is the easiest and quickest way for my son to get a full A licence with no power limits? If he waits until he is 19 and passes a practical test (A2) will the boy have to pass another test at some point or does his licence automatically upgrade after a period of time to a 'full A'? ..and kilowatts, really???

Hello all. First of all thanks for reading this I will try to keep it as short as possible. Last week a got a call from a CID officer stating that a "historic allegation" had been made about me by someone (name given). As far as I can recall I last met this person as a young teenager and I remember him being sent to prison at that time. This is all I can remember, I understand the officer cannot disclose any more information about this accusation but I am concerned as to what it could be. I am now in my late 30's so I don't know what I will be able to remember and I don't have the slightest clue what this is about. I know that the vast majority of police officers…

Wonder if anyone can help. I was arrested on a matter of fraud by false representation. This related to purchasing some transactions with my debit card and the funds not being there in my account (which they were a couple of days later from salary) so went ovedrawn and then the salary would swallow up the unauthorised overdraft, of which i paid the bank a premium for being unauthorised overdrawn. There were some times that I was unaware of that the bank returned these payments to my knowledge. I met the office by appointment at the local station and they wanted to see my bank statements to see if i did have a weekly incoming salary. During being detained they condu…
