S36(5) PACE essentially states that none of the roles of a custody officer with regard to a person in police detention can be performed by an officer involved in the investigation of the offence(s) for which that person is under arrest. If the custody officer instructs or suggests to an investigating officer to do something such as speak to another witness, view CCTV, seize exhibits etc are they 'involved in the investigation'?

What are your thoughts on civilians being allowed the following for self-defence 1. Items that help, but don't actually do any damage i.e rape alarm, marker spray 2. Items to injure/incapacitate (Tasers, baton, spray) 3. Guns I know some would like partial changes, but don't want civilians having particular weapons which is why I split this into 3 parts. I sometimes carry something from the first category, a marker spray. Ideally I would like pepper spray and a gun. And two questions solely for officers. Would you carry your parts of your PPE off duty, and which if so?

Hi folks, I'm in need of some advice. In my teens, I was taken home for being 'too drunk' - I didn't receive any caution, fine or arrest, just a good telling off. But the fact they had to drive me home suggests that I'm going to be logged somewhere? In the next year or so I'm planning on doing some programming lessons with students at a local school (It's part of this scheme that I'm involved in). I am aware that an enhanced CBR check will be taken, and I'm not sure whether I should tell my prospective employer about such events. Any advice is very much appreciated

OK, i'm wondering what the usual consequences / charge would be for the following actions ; I was shouted at in an aggressive manner, sworn at, had drink (juice) thrown in my face and then some various items (luckily they weren't really sharp or hard) thrown at me whilst being shouted at. What would that come under? The reason i'm asking is because i'm a support worker, and this happened to me whilst at work the other day. Its not a 'part of the job' and it's certainly not cool. Basically i would like to inform the client what would happen in this circumstance in usual society. (as he says thats what he wants to be a part of) Any help appreciated, cheers

Hello all, First post here. I have taken photos of a vehicle which does not have the front number plate displayed in the correct place, this was a month ago. The number is on the horizontal plane at the front of the bonnet on a 4wd and cannot be seen from the front, I think it's stuck on. I can see the tax disc in the photo which looks to be blue, with an expiry date which appears to be in early 2012. I got the number plate from the back of the vehicle. I was sorting some mileage claims for employees today and I was wondering if using your vehicle for "business" (a somewhat ambiguous term) without the proper insurance type would render somebody liable for prosecution for having no insurance under the RTA, as it would invalidate their insurance policy. Can anybody confirm this? I can't find anything concrete on the issue, but I have a feeling that it would constitute an offense.

Hi I had a recent controversial topic regarding a fixed penalty ticket on a private driveway. You are tasked to attend an address by another Police Force who have detained a female for Theft and carry out a Section 18 (1) Search under PACE. Authority for the search has been given by an Inspector in the arresting force. All paperwork on bothsides has been completed correctly. You attend the address and find the following: The detained person has been released from custody. She has been issued with a caution for the offence. The detaining force have not informed you of this. Do you still have the power to search the premesis under Section 18 (1) of PACE?

Hi all, I bought a bicycle frame from someone in the UK via a cycling forum. The seller used Yodel, a UK-wide courier company, to send the frame to me. After a few weeks I still had not received the frame and with the seller's help we came to a dead end when the courier company was not able to locate the whereabouts of the frame. As the shipment was not insured, there was no recompense apart from a minimal token compensation fee. I'm really curious to find out the answer to this. If a person went into a shop that is now in administration, eg a music shop for example and they selected goods to the value of say £25 and the shop refused to honour a gift voucher/card that had been bought prior to the shop going into administration and the person then left their name and address (real name and genuine address) and told them that they were taking the goods because that was the value of the vouchers and then left the shop with the goods.
