Good afternoon, To cut a long story short, last night I arrested someone for s4 drink drive. Back at the station I went through the MGDD/A with the detainee during which he refused to provide a specimen of breath and made no attempts. I went on to A11 on the form regarding any medical reasons, where the detainee said he has asthma and Asperger's. None of these were disclosed by him when he was being booked into custody and asked the questions for the risk assessment. I did not believe these medical conditions did not constitute a reasonable excuse, so he was charged with failure to provide. Hey, longtime lurker. Occasional poster. As I understand it only police cars are permitted to have flashing rear red, however as per other topics most people on here wouldn't give a ticket to and ambulance or recovery truck etc.. With that in mind what are peoples thoughts on what I witnessed today? S5 Firearms Act defines various things as prohibited weapons, including: "any weapon of whatever description designed or adapted for the discharge of any noxious liquid, gas or other thing…". My question is whether this includes lucozade or jif bottles filled with ammonia or drain cleaner for the express purpose of squirting in peoples' faces - to my mind it clearly should, yet while these sort of weapons are increasingly common I've only ever seen people found with them charged with possession of an offensive weapon. If anyone could help with this traffic query myself and a colleague were discussing on patrol the other night. If we came across a vehicle parked on the public highway which after investigation or by ANPR hit driving past (differences?) What would be if any, the process for dealing with this vehicle. As I say, the vehicle is parked unattended in a quiet residential street, and has not been seen to be driven. As far as I read into S165A the vehicle must be seen to be driven to commit the offence... help

Am i right in thinking that a constable can use this section to stop any vehicle for the purpose of subsection 1 but would it need to be authorised by rank of superintendent or above? I wasn't sure if it was best to make this thread here, or in the scenario section. Company A does home delivery. They use vans which are 3.5tons. The maximum amount of shopping they are allowed to load is 860kg. If extra is put on, I know the driver gets points/fine. But does Company A get any kind of fine? For allowing the driver to do it? How long is a search warrant granted under s26 theft act valid for?

Let's assume somebody presents themselves at a front counter at a police station. Let's also assume that this isn't a police station with a custody suite (and is not designated nor staffed as such - so s54 PACE isn't readily available to be used). Chappy that's presented himself is wanted for an offence / on warrant etc. and requires arresting. My question is: apart from the obvious "follow me outside for a second" is it possible to use s32(2) PACE in this scenario? This question has arisen: Can a police officer search a young person or their belongings if they suspect they are in possession of alcohol? I understand that a Community Support Officer has this power under Police Reform Act, however I've reviewed this and Serious Organised Crime and Police Act 2005 (where I thought the above had been amended to allow Police Officers the same power) but can't see any references to a police officer. I also looked at Confiscation of Alcohol (Young Persons) Act 1997... "the constable may require him to surrender anything in his possession which is, or which the constable reasonably believes to be, intoxicating liquor". Thoughts?

My favourite Act of all! Under Section 8 Robbery is defined as aggravated theft. Is this the legal terminology for mugging? I have yet with my scanty knowledge of Criminal Law to come across 'mugging' in legal documents. or am I being a mug? Out of interest did other candidates find the KEEs very hard? I'm so worried about everything it's making me tense .
