In BTP we can issue PNDs on the street 16-17 year olds for non-recordable offences with no appropriate adult. For other offences our force policy states they must be issued in custody with an appropriate adult present. I was wondering, if this is the case, can a juvenile be reported for non-recordable offences without the prescence of an appropriate adult, or does this only work for PNDs?

Is there any offence that covers the deflating of a car tyre or tyres to someone else's vehicle (without the owner's permission) so that it is left in an undriveable condition until they have been inflated again?

I heard the other day that a person cant be charged for TWOC if the vehicle is on private property? Can anyone confirm?

I expect this has already been answered but I can't find anything on the forums & it refuses to accept MOT as a valid search parameter!!! If you forget to MOT your vehicle what is the penalty, & is your insurance invalidated? I seem to recall there used to be a grace period of about 2 weeks after the expiry date, which if you got it sorted by then you were ok, but as everything is computerised I heard this was no longer the case. The reason I ask is a colleague has done the above & is now very worried as it ran out 5 weeks ago & they've only just realised!

Manning the phones at the control a couple of days ago, this cropped up... Person enters store and shoplifts - simple theft. However, whilst talking to the security guard who detained the person, it turned out that he had been banned from the store in the past and, as such, had entered as a trespasser and attempted to steal items. Now, with the new element of trespass, it technically fits the definition of burglary. Others who I discussed this with were of the opinion that it was still only theft, as there was a right of entry to all other members of the public... But I'm reluctant to beleive that! Can anyone clarify this for me?!

Last weekened I had a persistent MOP that was trying to push the buttons on my airwave, after a few times I got bored of pushing their hand away and threatened them with an arrest....In this siutation it was enough for the MOP to walk away, However the only offence I could think if any was wasting police time? My brother moved in with me and my dad about two years ago, with lots of debt. We paid it off for him, and he got a mortgage and moved out with his fiancee a few months later. About a year later, they had a big split, and he moved out, leaving her with the mortgage, and more debts he had racked up. He then left down south. My ex landlord has given a statement to the police stating that when we moved out of his property we stole his electric oven. Our problem is that we told him on the very first day that our tenancy started that his oven was broken and we had one of our own that we could use. He didnt want to collect his broken oven and was fine with the fact that we intented to dispose of his broken oven. a man has been horrendously emotionally abusive to his girlfriend. I wish to grafitti something on his car in lipstick, using no swear words. Is this criminal damage? Just wondering if anyone could help work out what the offence would be for the following situation: If a person were to use someone elses account on a prepaid telephone card system (one that requires the inputting of an account number and a pin number) without that account holders permission, what would be the offence. As far as I can remember, it is not possible to charge with a deception offence, as a computer cannot be decieved in law. Is this correct? Any help in this would be greatly appreciated.

My mum recently had to go to a speed awareness session (She was doing 40 in a road that had only recently been changed to 30). one guy there claimed he was "done" for doing 33 in a 30 zone, and the person running the session said that is not possible because the police only convict if the offender is doing over 10% plus 2 of the speed limit. I have tried to research this with limited success, I just want to know if it is true.
