Under schedule 10 of the new Criminal Justice and Immigration Act 2008, it states that cautions are now immediately spent (not 5 years later), and that they cannot be disclosed in any place at any time after the issuance of the caution and that for all intents and purposes, after the caution has been issued a person is regarded by law as not having a caution of any kind. It also states that even when asked about cautions, they do not need to be disclosed. I had recently attended an incident involving a male who had taken "Magic Mushrooms". 14 years as a Special put me to shame as I had a mind block on what to do. The ambulance was in attendance. They said there was nothing they could do as the male was lying on the pavement uninjured. He wasnt violent and was just hallucinating. The ambulance said there was nothing AE could do and there was about a 5 hour wait. I contacted custody who said for me to take the male to the hospital. They did not want him in custody. At a secondary school a teacher's mobile phone stolen. He puts up a notice on the noticeboard that reads: "My green nokia phone was stolen last wednesday from my pidgeon-hole. It had some pictures on it that have a great sentimental value to me and I would like it returned. Please put it back in my pidgeon hole this week and nothing more will be said." It is subsequently returned, but it is not know who did it. From this scenario, have any offences been committed, apart from the theft itself?

you arrest someone for obstructing police, put them in your car and then deal with what ever they were obstructing you doing. if they have then calmed down you feel that they are sorry and it's a busy friday night can you just de arrest them. do you just need to record in your note book whats happened.

im aware that deactivated firearms are legal (assuming done with the required proof house cert, not public place etc), but what about blank firers? they seem readily avaliable, do they fall under the same remit? is blank ammo not illegal to buy/own like normal ammo is?

Should the hort1 form have the offence written anywhere on it ?

A situation that often affects doorstaff (although I'm sure similar scenarios affect other people) is that someone who has been ejected makes an invalid complaint that they used excessive force. Doorperson is then either arrested , charged and bailed or asked to attend the police station a day or two after to give a statement then bailed. Is there any sort of guideline or rule that says police have to deal with these issues in good time. For instance one person I know had to wait 3 weeks for police to view the CCTV which then cleared him. There are other cases where the CCTV has been viewed and clearly shows that the complaint is invalid but the person is still on bail.…

I live in a converted church and in order to reach my apartment/house which is at the Chappel end of the building, I have to pass through the courtyard at the front of the building. Some time ago, the residents living at the front decided to reduce my and other residents right of access to a small pathway by building a temporary wall consiting of 3ft high planters. For parking offences I have only ever known for FPN's to be attached to the vehicle's windscreen. Is it possible to send an NIP via the post to the registered keeper instead?

As Scotland and the proper bit of the country* () have different laws then is the procedure for moving someone from E&W to Scotland after arrestor vise-versa any different or more difficut than moving them between other forces? Say, something that is an offence in one country or another, or say, if a 9 year old comits an offence in Scotland and then goes over into England - he can't be treated as a suspect in england, but he would be above the age of criminal responibility in Scotland, how would he be treated? *Scotland is a lovely place, I'm just jealous....
