Bit of a debate amongst some colleagues of mine recently, when arriving on scene at the arrest of a shoplifter by a security guard/store detective, would you expect them to have been cautioned using the same language that you yourself use as police officers? Some colleagues just tell them they are being detained on suspicion of theft and that the police will be called, whereas others give a full caution along the lines of I am arresting you for theft, you do not have to say anything but it may harm your defence etc... Which way is better, does it matter??

Is there a specific offence of an unqualified person offering legal advice? I know it's against the law to give immigration advice without being qualified to do so, and it's an offence to practice law without a certificate in many other countries....

PACE Code of Practice A (section 1.5) removed the ability of police officers to conduct searches of people where they have the consent of the person, but no other statutory power. However, I am unable to find any mention of vehicles. Taking the Code to it's logical conclusion, the government only want the police to use statutory search powers. That said, Code B allows property searches with the consent of the owner. Can anyone shed any light on the legalities of a vehicle search conducted only with consent, and any force policies?

I am struggling to find up to date information with regards to the law on whether devices that detect police radar traps are still legal to use in cars. The most recent finding was the Road Safety Act 2006 which made GPS devices that detect fixed cameras legal but those that detect mobile laser traps illegal but I could be wrong. Any views?

Hi everyone. Hope I've posted this in the right place. I just got provisionally offered a job where I will travel all over the world, but I was asked if I have a criminal record which will prevent me from going to Brazil and USA. I don't have a criminal record but I do unfortunately have a police caution for urinating in the street when I was drunk just over a year ago. I told my prospective employer of the situation and they asked me to find written information online stating that it won't be a problem with me entering Brazil or the US. Will it be a problem? Does anyone know the three digit offence code we use in the Met (not sure if it is a national code system or not) for "Using a hand held mobile telephone while driving" on the FPNs? I've only got the old code before it was endorsable. If there's already a topic on this, I couldn't find it. Thanks

I just a few questions about car insurance etc. 1) It legal for me to display Green P plates on my car permanently so my wife can drive the car ocaasionally who has just passed her driving test? ie Can I drive a car with the P plates displayed even though I have held a licence for 20+ years? 2) I was involved in a road traffic accident a few months ago and the police were in attendance and apart from breathalzing me and calling a firm to tow my car away on my behalf as it was a right-off they did not ask me to produce any documents or ID. Would excess speed, grossly beyond the speed limit be sufficient to process for Careless Driving? Say you follow a car at speed, and you dont have any speed detection devices and your speedo is not calibrated, would process of Careless driving be an option?

If a road is a private road and is clearly marked residents only then the RTA does not apply. So what does apply??? If you have a scrape in a private road, and you decide not to leave details what does the rule of the law say?
