    hypothetically, I bought a car, trailered it home and for the last week or so ive been getting i ready for it's mot (or retest) anyway, im waiting for the V5 to arrive, so tonight i was mucking about on the computer and decided to have a look on the ASKMID site, put in the reg number, and it came up as insured, as ive got fullycomp on my other car, and the previous owner hasnt stopped the insurance yet, can i drive it on the road to the MOT testing station without taking out a seperate policy (1 days insurance) as this would be breaking the law too or so im lead to believe, yes it's taxed until the end of the month i just want a general opinion, what would you do

    Person A assists and encourages Person B to commit a serious criminal offence against Person C, facilitated by Person B's ignorance of the law. Although ignorance is no defence for Person B, Person C feels compassionate for Person B having been exploited by Person A. Person C therefore wants Person A but not Person B to be prosecuted. In principle, can Person C report Person A (under Part 2 of the Serious Crime Act 2007) for assisting and encouraging Person B to commit the offence without Person B being prosecuted for the offence itself? Does Person C have any control over this, or is it a decision only for the Police and the CPS?

    There have been a number of cases over the years where someone has killed someone and then gone to some lengths to hide the body or destroy evidence such as burning the house down. These people have then gone on to claim manslaughter. I think the idea behind the offence of manslaughter was to cover situations where a fight or struggle goes tragically wrong and the person had no desire to kill at all, and is immediately remorseful. In those circumstances, surely the killer would immediately phone an ambulance or the police.     Hello, a query on S3. CLA. The phrase 'prevention of crime', does that relate to crime believed to about to be commited, or currently being commited? Also prevention of crime is a very.. obtuse word. Are you able to cite some scenarios where this would be used? And what it may not cover? Although a useful piece of legislation, it doesn't appear in any of the Blackstone Handbooks as far as iv seen. s3(1) of the Criminal Law Act 1967 provides that: "A person may use such force as is reasonable in the circumstances in the prevention of crime, or in effecting or assisting in the lawful arrest of offenders or suspected offenders or of persons unlawfully at large."

    I thought i was okay with traffic until a colleague completely confused me (this is the second time aswell) on Traffic Law. For offences such as Not having a Seat Belt on, a FPN can be issued, however if the FPN is refused or person won't give you their details (assuming it wasn't the driver). Do you actually arrest for that offence with the necessity test, or is there seperate legislation for Traffic law? I understand that in reality I will hopefully never get to the point where I have to arrest someone for a traffic offence which could be done as an FPN with option of court.     An OIC has provided a MG11 in which he states that he arrived at the scene of an incident and then had a conversation with a witness. That witness allegedly told the OIC that the suspect had been using abusive language and the words allegedly used. The OIC then arrested the suspect under public order act. The custody CCTV shows that upon arrival at the charge desk the OIC cannot state the words used. The OIC does not mention any conversation with the alleged witness.     has anyone else seen this tv program on channel 5, how the hell they have managed to get a licence in the first place, and then manged to keep it i dont know, the idiot in the first show was a typical essex boy prat, drives everywhere at 15-20 mph, cant park to save his life, this week im not sure who was the worse, the young mum who drives everywhere at break neck speed, or the young lad who drives too fast and too close, while eating, drinking, useing his phone, and driving with no hands it beggars belief

    Hi guys, sorry if this has already been covered or if it seems a stupid question (Im new!!) What is the actual offence of urinating in a public place? I've heard people talk about Section 5 POA 1986, but on the other hand I've heard them talk about it as an offence on its own, and im very confused. Any help would be appreciated. Thanks

    Has anyone ever known of someone to be bailed to an address overseas? It appears to have happened in one of my cases and just seems rather odd: not to mention the fact that he was actually on his way back home when I nicked him and has no connections to the country! Needless to say I remanded him to court and wrote a full remand application! Yet the court saw fit to bail him to another (EU) country.... Most peculiar. Anyone else ever had this?

    Hi All, had a situation where a 8 month pregnant woman wanted baby clothes from Ex's house. We went there at her request asked if he would be reasonable and let her have them, but he said no. She lived there for 2 years but has been out of the property for 6 months.She has a key to the property. As the property is owned by the partner we could not force the issue and said to the lady that it was a civil case and she had to go via a solicitor to get her stuff back. This was based on info we received from the duty Sergeant. Is there anything else we could have done?

    Long story short - domestic abuse over 8 year period, relationship ended 3 years ago, ex partner has continued to harass me, has assaulted me, our child and my new partner. We are going to trial in the near future as witnesses against my ex for his continued harassment, although the charge is breach of the peace domestic. I found out today from Victim Support that the sheriff has declined the application they made on my behalf for special measures. (A screen and a supporter) whilst I am giving evidence.
