Last night on Five's excellent programme, the Clubs and Vice people closed a bar down on the basis that they knew that certain people were likely to be attending who might cause trouble. Does anyone know what power(s) they used and what evidence of planned violence there would have to be before this power was used?

Folks, There is a discussion in the office that we can't find the answer to. The statute is silent on the power of arrest when it comes to Vandalism under sec 52 CL©(S)A 1995. Assuming you have detained someone under sec 14 CP(S)A and later interview them for the offence. If they admit to the offence and you have evidence to charge, do you charge then arrest, then release, or just charge and release without moving to the arrest? Any thoughts (and explanations why) would be really appreciated.

I popped in to a major supermarket's petrol station today on my bike. Up went the flip face on my helmet, placed the nozzle in to my tank and stood there like an idiot as no petrol came out. I put the nozzel back on the pump and tried again, no petrol. I looked over to the cashier and she looked back and I tried again, still no petrol. This went on for a couple of minutes until one of the staff stacking the outside shelves shouted over that I had to take of my helmet. When I went to pay I asked why and was told that it was policy that all petrol stations required bikers to remove their helmet (even though this was the first time it had happened to me in a few years!)…

There is a legal principle that the law is not concerned with trivial matters (I can't remember the precise Latin formulation for this, but no doubt someone will remind me). Where someone is prosecuted for a trivial example of an offence that person should be found not guilty. What I'm wondering (from someone who knows about such things) is where the De Minimis principle means that it's not worth prosecuting and convicting people of trivial offences, or whether it is stronger than this, and that if a person has only done something trivial then even though it technically appears to fit the wording of an offence, that person has not actually committed the offence. Hi all, I have a question about the proceeds of crime act and how if you find someone with over £1000 either in cash, cheques, bonds etc you can seize that cash under the proceeds of crime act and section 19 of PACE, the punter is then to be arrested on suspicion of possession of criminal property, provided you have reasonable grounds to suspect that it has been earned by illegal means. My question is this, if when you interview them about where the money has come from and they say that they have been saving their benefits up, is there any stated case which says that benefits are only enough to support someone and not enough to save ie negating this defence? Upon giving the standard caution what is the code g caution and how is it worded as i was told it is ineffective without it..

The law says that, in theory, you should carry your UK driving licence with you at all times whilst driving here, in practice, every single police force will allow you 'time to produce', which means you have to produce your licence, insurance and MOT certificates at the nearest police station to your permanent address within, normally, seven days, My question is this,- where on earth does it say these rules in any of the traffic codes of practise or highway code??I know on training we were told the above is correct and really we should caution any driver we stop who has not got there licence on them. Hi all, Just to confirm..... Saw an incident the other day where someone was getting quite a bad kicking as they lay on the ground from a couple of youths - my first instinct in this event is that an arrest could be carried out for the assault, but.... On thinking about it, even though it appeared he was getting quite a nasty beating, I could not say for certain that his injuries amounted to anything more than maybe a few bruises, so its going to be a common assault (and battery). Where a secondary road meets a major road, and where motorists on the secondary road have a "give way" sign, they must give priority to vehicles on the main road. But must they give priority to pedestrians walking along the main road (i.e. crossing the secondary road at the junction)? I am asking this question as a pedestrian; is it right for me to start crossing, and expect cars on the secondary road to give way for me?

Hi Can anyone tell me if a conviction in Mag. court for travelling without a valid ticket will show up on a crb check Railways bye laws 18 & 24 under sect. 46 &sced. 9 railways act 2005.

If someone isnt arrested buy summonsed to court, do they need to be interviewed, or do they just give their account to the court? Also, whats the procedure for determining what you can & cant summons for?
