This is a summary of what happened - Basically in a nutshell the individual gave away £12k to a charity of money that didn't belong to them. But in order to do so had to manufacture certain documents in order to achieve this. They were drinking heavily at the time and this along with ridiculous pressures at work spiralled into making an epic mistake. I have been revising around sexual offences online and with Blackstones. I have got to sexual offences and in particular position of trust. From what I have read so far under section 21 am I correct in saying positions of trust would be social workers, teachers, nurses, doctors, police? Scenario question I have been given is a teacher has consensual sex with a 17 year old. The 17 year old is not a pupil and the teacher has no dealings with the 17 year old in her capacity as a teacher. Does this constitute an offence? From what I have read and my understanding I would be inclined to say no? due to the fact the 17 year old is not a pupil.

Just a general question in relation to use of force and handcuffing. What legislation would cover the use or handcuffs? Colleagues of mine often say handcuff for every arrest, but this has me thinking what legislation covers this? I can understand handcuffing a violent detainee to protect the officers and the detainee. But, for example a detainee for theft offences, calm and compliant?

I was arrested for assault on Sunday after my partner went to the police after a row which got very heated and i dug my nails into his arm while driving. The police didnt charge or caution me and are trying to get me on a programme designed to keep woman out of the justice system. Will this show up on a crb check? Will they inform my partner what the outcome was?

Legislation states that a Section 59 notice (RTA) can be issued by a constable in uniform. An off duty constable (therefore not in uniform) has witnessed an incident that satisfies the requirements of a S59 notice to be issued. The S59 is issued. Recipient is informed in the usual manner (letter etc). There is no appeals process for a S59. What are the possible outcomes?
