Mr and Mrs Smith have lived in their house for 30 years. It is in a rural location with a large and secluded rear garden. Both Mr and Mrs Smith are keen bird-watchers and have, over their time in the property, cultivated plants and trees and put up nesting boxes and feeders to attract wild birds to their garden. They also have an aviary at the end of the garden containing some exotic (and expensive) captive songbirds. Mr and Mrs Jones move in next door. They own 3 cats. Over the next few weeks Mr and Mrs Smith notice a steady decline in the number of birds in their garden, coinciding with increasing visits to the garden by the cats. Mr Smith tries mirrors, chemicals and …

Hi everyone, I'll start with the obligatory ''no this isn't something that has/will happen and doesn't relate to me or anyone I know'' and ''I have tried searching the forum''. :D ''It's 19:30 when you're in your local supermarket. You use the self-service checkouts and pay the correct amount for the items. On your way out of the store you are approached by a security guard asking to see inside the bag. However you decline his request as you are sure in your own mind that you have not done anything wrong. You carry on walking out of the shop and back to your vehicle''. Q1) Do you have to stop when instructed by a security guard and comply with any requests e.g 'Can you…

Just watching "Bailiffs" on Watch on Sky and two bailiffs were being pushed quite aggresively from a kebab shop by the owner. I saw the end of the scene so not sure whether they were actually trying to remove goods or just talking to them. I know that landowners have a right to use reasonable force to remove trespassers from their property but does this power still extend to this situation where bailiffs are carrying out their duties? They called the police but the bailiffs saw them drive past so they too drove out of the area. Would there be any assault? Oh and I'm watching Watch+1 so I might get to see the full scene in about 20 minutes.

Ok, this is theoretical ONLY. But, say you worked with someone who got a driving ban last year for drink driving - a 3 year ban. However, you recenetly learnt that they continue to drive, on atleast a weekly basis to work and back using their girlfriends car. Which on an ANPR check would come back as insured, taxed ect as it is, but for HER not HIM. What would you do, have a quiet word to them at work and give them some advice, or report them and let the authorities deal with it? Or take other action? Bearing in mind that you have to work with the person everyday, someyou dont want to cause any unnessicary friction.... Thanks for any adivce...

Pete buys a burger form a burger van and hands over the money as the burger is being cooked and prepared. As the vendor hands the burger over, Pete sees the vendor has been handling money and then notices the vendor has that awful habit of licking his fingers before picking up a napkin to wrap the burger with (rather like that weird and unconscious habit that people turning pages have - lick a finger before turning the page). Pete decides that he is no longer happy with the standards of hygiene and rejects the burger. Aside from possible EHO issues re. food handling, money handling and licking fingers (for whatever reason), would there be any offences in demanding his mo…

A very simple question really. In the real world things are different but I need to be clear in my head the correct technical situation. You get a call to McDonalds (other burger stores are available) in response to a report of ten teenagers being a pain. Upon arrival the staff confirm that they are a pain (no offences really) and have ignored their requests to leave. The staff are expecting you to remove them. Am I right to think that the store is private property so it is down to the manager to remove them not the police. This would need explaining to the manager – "you need to physically remove them not us" I know that in the real world the majority/all of the …

This happened today at work, and I would be interested to know if any law had been broken, or who would be culpable for any damages. Now I wasn't a witness to this, as I was at the other end of the Pub, but I heard it happen, I spoke to neither party, and received information after the fact from another couple who did witness everything. I hope this hasn't been done before and I apologise if it has, or if this is so numbingly easy that you find it a waste of your time. Was interested in your thoughts on this case..Posted this on a cycle topic a few weeks ago, but was last post on dying Link. Could not help but feel a bit sorry for this PC. Had a long chain of correspondence on one of my regular blogs about this bit of video. PC seems a bit lost, but the cyclist is being a nightmare. What would you do in this scenario. Would be interested to see the difference on this site compared to you tube and the cycle blog I saw this on. http://www.youtube.com/watch?v=jzIKXC7QAdg&NR=1 I was thinking tractor battery and set of jump leads myself What would you have done?

So there you are, in an unmarked police car. The officer you are with is texting on his mobile phone as you're stopped on a long and slow operation. The radio is on, you're just chilling. From time to time, the car has to be moved. The other officer is driving, but keeps texting as he is driving. You debate saying something about it, but you're new, and you don't want to seem churlish. On the one hand, you know that what he's doing is illegal and possibly dangerous. "The worst case scenario", you're thinking, "would be if something should happen, like you hit another car - or they hit you. If you'd have to give a statement, you'd have to say that you knew the polic…

John is a store detective employed by a well known department store. He gets a call on his Radio stating that Jessica a well known shoplifter (who has previous for shoplifting from retailers) has entered the store. John then follows Jessica around the store; John does not see Jessica take anything, after a few minutes John receives a message over the radio stating that Jessica is wanted by the local police for questioning for other offences. John then detains Jessica and locks her in a holding room. John then contacts the local police stating that he has Jessica in custody to answer their questions. IS JOHN COMMITING AN OFFENCE BY DETAINING JESSICA??? And if so what …

A driver is involved in an RTC fail to stop, he/she makes Off and gets home! It takes two hours for the police to catch up with him / her in this time he drinks half a bottle Of whisky to 'calm his nerves'! Would you prosecute for drink drive as well as fail to Stop! If so how could you prove they were under influence when the accident occurred! This is a real example and I will post the outcome later!

What would be the situation if someone, be it witness, defendant or someone else involved in the trial refused to be searched as a condition of entry to a court? If someone is there under summons then they have complied with the order of the court to attend - and, as far as I am aware, summonses do not stipulate that a person must consent to a search. So, we have the situation of the person standing in the court - but being refused access into the rest of the court building - but who has turned up as they are obliged to do so....
