Obviously simple trespass is a civil matter and generally not for the police to get involved in as a matter of routine unless a BoP is threatened. Normal procedure would be to get the owner/controller of the property to request the trespasser to leave in your presence and then make an attempt to remove them and only to get involved if the person kicks off. However, where I work there are several locations where groups of youths congregate and ASB and Crime results. Some of the offences are quite serious (weapons offences, criminal damage etc.). I know of a limited company that went into liquidation and closed last year due to difficulties in generating new clients and revenues. The liquidation was handled by a licenced insolvency practitioner. A few days ago, the now ex-directors, received a letter from a creditor alleging that they had overpaid about 10K (GBP) to the limited company over a year ago and are threatening the ex-directors with "Retaining Wrongful Credit" in accordance with the Theft Act 1968. They have threatened to take criminal sanction against the ex-directors unless this alleged overpayment has been repaid within 7 days. Is this a criminal matter ? or a potentially civil matter ? Apologies if covered - If a taxi driver asks an officer to remove passengers from the car, and explicitly states that he does not want them to remain there, if the passengers refuse, (for sake of argument, there is no dispute over money, just stubbornness), are the passengers trespassing? What gives us the power to remove them, with force if necessary? Or is this a ways and means job?

Can a constable force entry in to a vehicle to search it under s.1 of PACE? S.117 gives us a power to use force to under any other provision of PACE - so if s.1 allows us to search a vehicle, can we use s.117 to force entry to do so? I'm thinking of a situation for an abandoned vehicle, or even a stopped vehicle where the driver point blank refuses to exit or unlock the car (this may amount to obstruction however that is a summary offence so can't force entry to arrest for that). Hi all. Just looking over my notes. Please correct me if I am wrong. S5-4A POA. Can only be committed in public but if in private/dwelling and words used/visible representation is seen/heard by a member in public, it can be committed. S4 Can be committed in public/private but not dwelling unless it is is directed to a member in public from dwelling. S3 Can be committed anywhere (but in stated case if inside dwelling and unlikely anyone would get there, no one will get charged) Am I right?

It was touched on in another thread how on a traffic stop, the occupant of the vehicle isn't necessarily obliged to step out of the vehicle when asked. This got me thinking, what point do they become obliged to exit the vehicle? I've witnessed a few PCs i've crewed with ask the less happy customers to step out of the vehicle and join them at the roadside rather than speak to them in the car, but what would happen if they refused to step out of the vehicle? At what point am I allowed to forcibly remove them if appropriate?

Can anybody tell me the legislation that defines what trespassing is please? Also another question i have is the following; if the police turn up to a house which has squatters inside and when the Police try to talk to the owner of the property he declines speaking to them. Can they remove the squatters under S144 Legal Aid, Sentencing and Punishment of Offenders Act 2012 if the owner hasn't told them if they are trespassers or not? Thanks for any help in advance

Here's something I was think of the other day that could be interesting. The hype this year seems to be on smartwatchs (for those of you that don't know what I mean click here for the release on Google's version) so i;m sure later on this will become more common. So what are people thoughts on legality of using them whilst driving. I honestly don't know where they fit in as I can see that whilst the use mobile frequencies for interactive communication (via the phone) you can use them just by speaking so they are handsfree. I think that the government does need to offer some official guidance.

Hi all, Just a quick query re the offence of failing to stop for a police constable. If you signal for a vehicle to stop and the vehicle does not stop immediately but carries on for several minutes before coming to a stop, does that still constitute an offence, as they haven't stopped immediately? Let's assume that the driver has seen you and there have been plenty of safe places to pull over. Thanks.

So i have recently bought a moped and already have my car licence and will be taking my CBT in the next few weeks but i have just read on the Gov website for mopeds If i already have a car licence and if i pass my CBT then i am able to ride a moped until my car licence runs out but my cbt still runs out in 2 years. also it says i am allowed to ride without L plates. so if i get pulled up by the police would this be the case where i am right ? here is the link i just don't want a fine or points on my licence https://www.gov.uk/cbt-compulsory-basic-training/cbt-if-you-have-a-car-driving-licence

Hi all. Just thinking about my use of force powers, I can't find a concise definition for use of force under common law use of force , can anyone please help? What are the practical considerations for using common law use of force? (ie why common law over s3 cla?any examples?) Also for bop power of entry, what are the practical considerations for using it? Eg you are on patrol, you hear loud shouting and arguing inside a house. Situation doesn't really warrant a s17 pace entry to save life and limb but would you get in trouble for using a bop power of entry to prevent bop?

When a case is presented to the prosecution service are they informed about any police complaints related to the case, either brought by the accused or by third parties? If so, are they given full details? How can it affect their decision?

Just racking my brains for the Code G to arrest a Disqualified Driver? Prompt and effective? - however if they would voluntarily attend an interview then this surely negates this? Thoughts please?

Don't think we have been taught this, but maybe just me being forgetful, so just a quick question. If you attend a call and collect the evidence, but a suspect says no the property is theirs, what laws gives the officer the right to take the property off the suspect for evidence? for e.g you see a suspect wearing a jacket with a blood splatter and you were told there was a robbery 10 minutes earlier up the road etc. Another example is an youtuber gets out their phone and repeatedly shout police brutality while you are just carrying out your normal duties, and ending with them getting arrested for obstruction after warning, I assume officers have legal rights to take th…
