What are the offences that a MOP can detain an offender in Scotland for? I understand there is no definition of arrest other than Constable's (unlike here in England/Wales); I would appreciate if any one could quote the definition of the detention in the Scottish common law. Hey folks , Should those who are found guilty of possessing a knife in a public place be given an automatic 6 month sentence? (expand your answear) It was supposed to be for 2 years but Tory MSP Bill Aitken was the only MSP to vote in favour and was rejected. Is S.58 a human rights abuse...?

As we all know, we have 6 hours of detention available to us. With the introduction of Disclosure and the duty that places on the service and us as individuals - is 6 hours enough? The Disclosure model has been copied from England which is fine but they have 24 hours when they 'arrest on suspicion'. The duty put on us to explore alibis and present exculpatory information can be a lot, even more so in such a short space of time. Thoughts?

What powers do the police have if any in someone's house, i.e. you go to a domestic incident, the house is owned by the male but the female wishes to make a complaint against the male, she is questioned in the living room of the male's house but the male refuses to leave the living room, do police have any powers to tell him to leave the room and keep him out to avoid disturbing the questioning? Or can he do as he likes in his own house? What if he begins to butt in when the female is talking and starts arguing with her? What about if it was someone being interviewed under caution? I know a breach can occur in one's own house, but I'm just wondering if there's any power…

Had an unusual thing happen this afternoon, I was standing at a bus stop in central Glasgow, minding my own business when a chap came up to me and started shouting obscenities at me It went on for about 30 seconds, and then he walked off. I was a bit taken aback and of course wondering if it would escalate. I was just wondering what sort of offences were commented here, and would a guy shouting random obscenities at strangers get a quick response from officers if reported ?

Is it possible for a member of the public to make a citizens arrest on an officer if the officer has been seen by a number of people to be acting unlawfully ?

Is it illegal to photocopy money, even though it says 'TRAINING PURPOSES ONLY' on it?

If a constable who is off duty or in plain clothes uses their warrant card to attempt to have someone stop their vehicle for whatever reason, for example sake say the vehicle was believed to be a danger to the public e.g. the driver was driving dangerously, has the officer committed an offence or done anything wrong? I know the road traffic act says a person must stop when required to by a constable in uniform.

All, I was asked a question the other day and wasn't quite sure of the answer. I'm aware of the standard disclaimer for the form, etc etc! He stupidly agreed to take a car out on finance in his name and gave it to his girlfriend to use - the inevitable has happened - They have split up. She's not been paying the finance and he's had debt collectors contacting him about it. He is proposing to get the car from her and take it to auction to sell the car and re-pay the finance, however she's not letting him take the car. I understand most of it is probably a Civil matter, However the issue with the fact that she's not giving him the car, even though it's in his name. …

I'm sure we've all interviewed suspects before, be it when formally detained under S14 Criminal Procedure (Scotland) Act 1995 or a quick notebook Q&A under caution for minor offences, e.g. vandalisms. As we all know, the suspect has no right to have a solicitor present however they are under no obligation to answer any questions, unlike in E&W where adverse inferences can be drawn from a refusal to answer. I always thought that there was no need to have a solicitor present given that there is no obligation to answer questions and no inferences can be drawn from that here. I had a conversation with a regular colleague recently who informed me that police officers can now be required to produce their notebooks in court. This is apparently as a result of a stated case that occurred very recently (in last month or so). If so, this would obviously be quite a change as previously we only had to allow our notebooks to be examined if we used them in giving evidence. If we didn't need to use our notebook then the defence could not use a notebook in cross-examination. I was wondering if anyone could confirm if they have heard of this and provide more details? This could be an issue for the odd cop who appears to be allgeric to writing. :D

I know this situation is a civil matter, but given the welath of experience that you all have, I would like to hear your opinions on this situation. I park my car in car park A. The restriction is 3 hour limit, no return within 3 hours. Three hours later, I move my car to car park B (different name on car park signs, but enforced by the same company).
