Common Law Definitions 1 2

Legislation.gov.uk is the main source of statute law but is there a similar repository of the "correct" definitions of the various common law offences that the public can access (i.e. not PNLD)? I wanted to link to the differences between abduction and plagium the other day and a quick search didn't turn up anything. If there isn't anything decent online then I suggest turn this thread be used as a repository for those lovely "X is a crime at common law" definitions we know and love.

Any advice on a specific area of law is from either currently-serving UK police officers, and is offered to the best of their ability, or from members of the public who are perhaps aspiring to be serving police officers and may not hold the necessary level of knowledge to provide such assistance or by any other member who may offer their opinion. Either way such advice can only be treated as an opinion and nothing more. The information is based on their own individual experiences, expertise and training. It is stressed, however, that if any information or advice found in these forums is used by any person or organisation, then the respective police officer(s) and sta…

Pressing charges

Can you change your mind about pressing charges? ..... my mum was the victim of an physical and verb assault 3 days ago by a person known to us. The police attended but talked her round from charging the attacker and they went and spoke to the attacker regarding their behaviour. Now mum is thinking she should have pressed charges. At the time she had a sore neck and what looked to be 1 scratch down her face. Now that bruising has had time to come out she has fingerprint bruising down her neck where the attacker held her by the throat and 4 separate scratches on her face. She also had a lump on her forehead from being punched and a very painful shoulder from trying to figh…

Hi there, Just looking for some advice please...... I recently passed my test last year on April 2017, and i am a safe driver - never been in trouble with the police my entire life. I am 45 years old. In March 2018, in Aberdeen while running late for a very important work appointment i was over the speed limit and got 3 Points on my licence and paid a Fee - which is my own fault and i accept that. I have made sure to be very careful 100% since then, and was trying to keep my record clean till April 2019 (at least) - so i don't lose my licence (as i need it for my job). Yesterday while travelling back from Inverness on the A9, i was travelling at t…

A friend who lives in Scotland is in dispute with a tradesman who carried out work on his house. He asked me for help, but I am not sure myself... He would like to find out if he can secretly (and legally): - Audio record the tradesman when he visits his house to discuss the problems. The intention is to potentially collect evidence that may be useful if the dispute ends up in court. - Audio record another tradesman that he intends to invite to his house to inspect and comment on the quality of the work. He was unable to find any tradesman that was prepared to comment on the quality of the work on record. Paying a surveyor to produce a report would be too expensiv…

Hi I am looking for advice on my case. Me and my ex partner had a domestic at home where he grabbed me by the throat and threatened me with a knife infront of my children and told me to left the house which I did with my children and called the police . He was arrested and pleaded not guilty to the charge because in the statement it reads he had it to my face which he didn’t so now me and my child need to stand trial against him. At the time he was drunk and under the influence of drugs and is disgusted what happens this is the first time he has ever done this . Never been involved with police before. For being charged he will lose his job because of not having a clean dis…

Dog Attack

Last week my mother had the unfortunate experience of watching two Staffordshire Bull Terriers run up the length of her driveway and into one of her cats small enclosed beds, where both dogs then mauled the 18 year old cat. As my step father tried to remove the dogs and save the cat, he also was scratched severely on the arm and leg, resulting in a trip to A&E for an injection. Once the cat was finally released, both dogs were kept in the house and the police were called, who then took them away. Although the cat survived the initial attack, he died early the next morning due to a seizure. After posting information on Facebook, it became apparent that the …

If the police pull you up and you just sit there in your car without saying anything and them going ballistic, because you didn't put your window down due to having anxiety can they arrest you will they most likely rip your car door off or smash your window? We do have the right to silence, however majority of officers don't abide by it and go over the law to get you talking.
