Two brother are at home, both 16yrs, having an arguement. Jim says to Bob 'get out this house now and if I see you again I will kill you'. Bob leaves. What offence is it that Jim has commited. I've ruled out; 1) Assault - it clearly puts Bob in fear of harm but it is a future threat. 2) Sec 4 or 4a POA - it took place in a home. 3) Anti social behaviour - they are of the same household 4) Harrasment - its never happened before 5) BOP - not happened in my presence At the back of my mind I think that there may be an offence of 'Threats to Kill' (if so does anybody have details) but even this cannot be a condition threat to be counted.

A parents son/daughter needs the toilet they are aged 4. However there is no public toilets close and they are desperate otherwise they will wet the pants. So they go round a corner where it is out of view and let the child urinate in the corner. So there you are on foot patrol and witness what is happening. How would you deal with it ? Any thoughts Cheers Topman

Hi all, I was recently reminded of a situation that actually happened back when my dad was an Inspector (10+ years ago). There were two young girls (Our neighbour and her friend) in our street, playing so kind of girly game. They were around 4/5/6, but I can't remember exactly, it was a while ago. An elderly gent 60-70 came up to the girls and began talking to them. I was in my parent's room at the time and saw this, and so did my dad, who may or may not have still been in uniform (can't remember the exact details). He told me he didn't like men talking to young girls, and I didn't understand he meant paedophiles as I was pretty young. He went outside and talked to the…

Not really a scenario, but I was asked this earlier and wasn't sure so thought I get some views from here: Is accepting a local resolution an admission of guilt and could that admission then be used against you in a civil case? e.g. SMITH breaks a window belonging to BROWN. BROWN accepts a local resolution for payment for the repair and replacement of the window which is conducted through the correct channels. Could then BROWN then pursue a claim through a civil court? e.g. for loss of earnings if it was a shop window etc. or SMITH is delivering letters. The dog belonging to BROWN bites SMITH on the hand. SMITH accepts a letter of apology from BROWN as a local re…

You receive reports that there is an on-going domestic between boyfriend and girlfriend in a dwelling, this was reported by a neighbour of the two who is in their house next door, who said they heard screaming and shouting and the sound of things smashing coming from inside the property. When you arrive, there is no answer at the door, but you can hear screaming and shouting from coming inside. You decide to enter the dwelling to prevent a breach of the peace. However, when you enter you see both male and female fighting, you attempt to split the fight up but you are unable to do so. After approx. 5mins you along with other colleagues manage to stop the fight. On talking…

Is it legal to force a school pupil to take part in a PE lesson, with or without a note explaining why they can't take part? Also is it legal to make the pupil borrow 'pool' kit if the pupil is forced to take part ?

Person A gets it translated and scans it into the PC and edits it for their travel insurance claim. Person A sends it to person B to change the format of the document so it can be edited. Is their an offence for persona B or A? This has been in discussion a lot lately, what's yours views?

You are walking down a service road at the back of homes when you smell and see over a seven foot rear garden wall Cannabis being smoked. There is a garden gate. What could you do? I've thought it through and the only thing can see is that if you knock the gate and are invited in you can report them/caution them.

Say you're on foot patrol when you see someone in the alley smoking cannabis or heroin (identified by look or smell) as you approach they stop what they're doing and drop the smouldering drugs onto the floor. If the drugs do burn away is the arrest still good despite your evidence literally going up in smoke?

Senario: Someone is suspected of Drink Driving, they smell of alcohol, it is evident they drove to the locus as they had no other way of getting there and the car was parked outside, they were in possession of the car keys, however there are no witnesses that speak to the accused driving. They were subject to a 172 requirement where they stated they were driving. Following this they were arrested for failing a breath test and subject to a report to the PF. Question being, I am under the impression that the 172 alone is not enough to prove someone was driving? (eg. convict someone on there answer to the 172) I thought there had to be some form of corroboration. Any view…

An incident has occurred where you have had to close a whole street. You are manning a road closed sign and there is also police DO NOT CROSS tape across the road. A MOP says he needs to get to his house which is on the road that is closed. You inform him that he can't due to an incident that has happend he then starts arguing with you saying you can't stop him from going home and he is coming through. You repeat what you have just said but with this he ducks under the tape and makes a run for his home. What is the offence and what would the necessity for an arrest be?

Just a little scenario its not happened to me, just curious. Any suggestions would be welcomed. You are on patrol one afternoon and happen to be passing a 'scrap yard', at this point you see a local known nominal who has previous convictions for theft of metal namely copper and lead, counting what appears to be a lot of bank notes possibly around £1,500. You know that he doesnt have a job and that they have used this yard in the past when cashing in the metal in previous offences. You stop and speak to him, upon asking him why he has that much money on him, he says that he has scrapped some metal that his mate didnt need anymore, however, he was unable to provide you …

PC A and PC B are on patrol when they come across a man sitting on a wall. Both PC's approach the male and start conversation. The male does not acknowledge the PC's and refuses to engage in conversation with them. PC A then searches the male under S1. of PACE as he is refusing to co-operate. Is PC A's search legal? Is the male under any obligation to talk/co-operate with PC A? Is the fact the male refuses to converse with the PC's grounds for a search? Also if anyone knows of any case law regarding this it would be much appreciated. Thanks,
