Prae 764
Perfectly legitimate use of force there, clearly covered by s.117 PACE and s.3 CLA. The wrongness is the old folks getting involved, should know better at their age. Funny how the cause of these incidents is always edited out, I wonder why?
danswans + 133
I think he done the only thing possibly. Surrounded by people who could potentially turn that situation into an unfair advantage for the copper. The guy point blank refused to get his hands out so what else can he do on his own? DB11 + 224
The guy went to grab the officer's cuffs so I think he was definitely right to spray him at that point.

Admin Team Sir Penguin 648 Posted April 12, 2015 Admin Team Share Posted April 12, 2015 As Prae said the use of force complies with the relevant legislation. This circulated Facebook for a while but I believe it has since been removed. As always the comments included things along the line of 'police brutality' etc. If the male, like he says, is innocent then he should have complied and then the circumstances could be established. ScotLass + 638
It is still doing the rounds on Facebook. One of my friends has shared it on his wall and as much as I wanted to comment, I kept scrolling! Funny how she stops filming the minute the officer mentions evidence... I haven't been to my OST yet but from what I can see the guy was asked numerous times to comply and did not. I don't see how else the officer could have dealt with that in any other way as by the looks of things the crowd around him could have turned very quickly indeed, and the guy was putting up a fair struggle. SC Tom 16
Eh... I'd have probably have used open palm strikes or punched him instead of spraying him as we have CS and it would have messed everybody around us up. If I had Pava then I'd have sprayed all day long. SC Tom 16
Same reason this officer sprayed him. To retain my handcuffs. Also, I am issued with CS and am trained to not deploy it under a certain distance as there is a risk of causing burns or blinding a person due to the nature of the propellant. It also affects everybody nearby, not just the person you spray. So I'd hit him, safter at that range and less likely to cause further distress to those around me or in the entrance of a busy supermarket. PCSD 329
Don't see why age comes into it, I've only deployed CS once and that was on a 16 year. It was dark, he was drunk and the same height as me, get got taken to the floor, my colleague and I were surrounded by approximately 10-15 of his mate and he wouldn't stop fighting. He tried biting and kicking out at me so was sprayed while he was pinned to the floor and we managed to get him in cuffs. At the end of the day, if I were in the same incident as that in the video i think I could justify it, it comes down to effecting the arrest whilst considering the environment, persons present and NDM. The guidance on PAVA are to deploy it at 2.5 feet or more, because of the speed of the get. The propellent won't burn because it's mostly water - unlike the MIBK propellant of CS... Punching the lad isn't going to control the situation though, I think if anything it would make the situation worse. Especially if you look at the reaction from people when the officers knees the lad in the shoulder/torso later on in the video.
