Fedster + 1,307
Police vehicle collided with driver after he attempted to flee on foot. A police officer has been charged with dangerous driving following a pursuit related incident. PC Lee Rumsey, serving with Cambridgeshire Constabulary, is due to appear at Peterborough Magistrates Court on May 9 following an investigation by the Independent Office for Police Conduct (IOPC). The charge relates to an incident on August 29, 2017 when a police car was engaged in a pursuit of a vehicle in Morley Way, Peterborough. The chase ended in Celta Road where the 21-year-old male attempted to flee on foot and was in collision with the police vehicle, causing him to dislocate his shoulder. The man was arrested on suspicion of theft of a motor vehicle, failing to stop for police and possession of class B or C drugs. Cambridgeshire Constabulary referred the incident to the IOPC and an investigation was launched that concluded in December 2017. A file was passed to the Crown Prosecution Service (CPS) who authorised the charge. View On Police Oracle
Chaos + 151
All the suspect got was a dislocated shoulder, that I'm assuming was put back in place and it all better now.I hope the court can see reason with this one, the officer caught a suspect with a stolen car, and drugs... What more do they want!

For senior officers, politicians and the press to stand up and say loudly if the suspect had stopped when ordered to, none of this would have happened.

I am sure the Officer in question shared the same attitude as you. It does not look like its going well for him. 11 hours ago, Chaos said: I hope the court can see reason with this one, the officer caught a suspect with a stolen car, and drugs I agree, lets hop they can find a reason. Then determine if that reason was lawful. 11 hours ago, Chaos said: What more do they want! Who? The courts, the CPS, the Police or society. Chaos + 151
Who? The courts, the CPS, the Police or society. If the officer got out of the police vehicle and then rubgy tackled the suspect to the ground and as a result the suspect got a dislocated shoulder... Would that officer be charged with assault?I would suspect not! Just because the use of force has involved a car, the ledgeslation allows for officers to be charged with dangerous driving...
cookyy2k 536
Meanwhile if the officer just discontinued as soon as the vehicle failed to stop the guy may well have caused an RTC, got away with and stripped someone else's vehicle etc but the officer wouldn't be in the position of losing his livelihood and potentially liberty. Pursuits in particular give rise to too much risk (beyond that of an RTC) to officers and until legislative changes I can't see why anyone would get involved in one. Zulu 22 + 4,571
I feel that I must plead guilty to Dangerous driving in a similar incident. However the outcome was that the injured drive received a 6 months jail term. Now I must fight with my conscience. should I turn myself in, oh my, lucky me, it is now out of statute. Would that officer be charged with assault? [:sarcasm/on] Thanks for the comprehensive answer to my question [:sarcasm/off] Perhaps the use of a 1 ton plus chunk of metal was deemed not a proportional use of force. Maybe a rugby tackle would be considered a proportionate use of force. What do you think? 3 hours ago, Chaos said: I would suspect not! Chaos + 151
Yes, do you not agree? Are you going to pull appart every post I do?I don't know the full circumstances of the job, it may well be justified. The suspect could have tried running over the bonnet and fell off, a technical PVA just I would say still justified. is chasing a male running away on foot while you are in a police car clashed a pursuit? That actually raises an interesting question. Never thought of that before, I suppose that comes down to force policy?

I have pulled nothing apart, you used a scatter gun approach to the debate. I would have thought it reasonable to anyone with a view contrary to yours, that it would be wise to deal with each point you made individually for no other reason than clarity. 15 minutes ago, Chaos said: I don't know the full circumstances of the job, it may well be justified. Yes, it may well be able to be justified. Thats why it has gone to court, to find out. 15 minutes ago, Chaos said: The suspect could have tried running over the bonnet and fell off, a technical PVA just I would say still justified. As above, all will come out kin the wash. 15 minutes ago, Chaos said: is chasing a male running away on foot while you are in a police car clashed a pursuit? A pursuit of an individual in my eyes is a pursuit, no matter what mode of transport is deployed. Edited April 10, 2018 by Pavillion

No, per the APP definition: Quote A police driver is deemed to be in pursuit when a driver/motorcyclist indicates by their actions or continuance of their manner of driving/riding that: they have no intention of stopping for the police, and the police driver believes that the driver of the subject vehicle is aware of the requirement to stop and decides to continue behind the subject vehicle with a view to either reporting its progress or stopping it. Would that be individual Police Forces? S117 PACE and S3 CLA. It’s better than APP it’s the law. Let me know when you’ve read it and we’ll listen to your opinion. PS there’s a fair bit of case law too so don’t forget to read those bits too.
